GENERAL TERMS AND CONDITIONS LUXERIJ
- These general rental conditions apply to reservations and agreements regarding the holiday home de Luxerij, standing and located at Ronde Hoek 4, 7963 SC in Ruinen.
- In these general rental conditions, the term 'tenant' is understood to mean the person who enters into an agreement with us regarding the rental of the holiday home.
- These general terms and conditions apply regardless of your (previous) reference to any own terms and conditions or to other general terms and conditions. We disclaim any terms and conditions to which you refer or which are used by you.
- Agreements deviating from these general terms and conditions are only valid if agreed in writing.
Reservation
- We only accept reservations from persons who are 18 years or older.
- After you have made a reservation, you will receive a confirmation, the general rental conditions and an invoice from us within 7 days. We ask you to check these documents for accuracy and to report any inaccuracies to us immediately. If you have not received a confirmation of receipt from us within 7 days of making the reservation, please contact us immediately, failing which the reservation cannot be invoked.
- An agreement is concluded between you and us at the moment we have confirmed the reservation to you. The agreement concerns the rental of the holiday home for recreational use, which by its nature is of short duration.
- After receiving the quote, we will keep the dates reserved for you for 48 hours.
- You may be required to identify yourself at check-in. If the ages and identification do not match the indicated ages or numbers, the owner has the right to refuse the group.
- The accommodation is not available for groups of young people. We also reserve the right not to accept an application for other types of groups.
- Minimum bookable 3 nights, this can be deviated from during holidays and holiday periods.
Payment
- We ask you to transfer 50% of the rent and deposit to us within 7 days of the invoice date. The remaining 50% of the total invoice amount must be paid 1 month before arrival.
- The deposit and/or payment must be transferred to IBAN: NL24 RABO 0139 9356 06 in the name of Luxerij in Ruinen under Indication of the invoice number.
- By paying an instalment of or the entire rental price, you confirm that you have read and agree to the general rental conditions. The rental ends automatically after the expiry of the agreed period.
- If the amounts invoiced to you are not paid on time, you will be in default immediately after the expiry of the payment period. In that case, we reserve the right to cancel your reservation and dissolve the agreement.
Deposit
- The deposit is €750 per stay. The deposit serves to guarantee damage and/or costs (in the broadest sense of the word) that we may suffer in the event of non-compliance with the obligations of the tenant as a good tenant and the person(s) who accompany the tenant.
- The deposit or any remainder thereof will be paid after settlement of claims (damage to inventory/holiday home and/or other costs) will be refunded to the tenant within 14 days after departure. Any (further) claims for compensation will not be nullified by this restitution.
Receipt key
- A time is agreed with the tenant for the transfer of the key. The tenant is never entitled to the key or duplicate it for any reason. If the tenant does so, the tenant is fined €500, without prejudice to actual costs. The key of Luxerij is loaned by us to the tenant for the key remains our property. In the event of loss, theft or any other loss of the key the tenant owes an amount of €100.
- All costs incurred because you do not deliver the house on time will be recovered from you. Goods found after your departure, we will keep for you for a maximum of 2 months, but we will not take any responsibility for this. Steering on your cost.
- If the tenant and/or other users have locked themselves out of the holiday home De Luxerij, €50 can be paid for this into account. This will be deducted from the refund of the deposit. For verification, the tenant may ask you to first before the copy key is handed over.
Cancellation
Cancellation by the tenant must always be made in writing (by post or by e-mail). The following rules apply:
- In case of cancellation up to 42 days before the day of arrival, 25% of the rent will be charged.
- In case of cancellation from 42 days to 28 days before the day of arrival, 50% of the rent will be charged
- In case of cancellation from 28 days to 7 days before the day of arrival, 75% of the rent will be charged.
- In case of cancellation from 7 days to the day of arrival, 100% of the rent and final cleaning costs are due.
- If you have not arrived within 24 hours of the agreed date without further notice, this will be considered as a cancellation and 100% of the rental fee is due.
- In case of cancellation on our part, any money already paid will be refunded.
- In case of cancellation by the tenant, deposits such as final cleaning and deposit will be paid according to the above conditions refundable.
Stay in the holiday home
- On the day of arrival you can use the holiday home from 16:00. On the day of departure, you must leave the holiday home before 10:00 am.
- No open fire may be used outside (only in consultation with the owner and in the designated places at windless weather). Also, no other things may be burned in the barbecue.
- The use of all facilities in and around the holiday home is at your own risk at all times.
- The rental includes bed linen, towels, bath towels and bathrobes.
- The use of gas, water and electricity is included, but we ask you to use them sparingly.
- Subletting or subletting is expressly prohibited.
- Accommodation of more people in a holiday home than agreed on the reservation, or than the applicable to the property A maximum of 16 people is expressly not allowed without our permission, unless otherwise agreed in writing. This can lead to the premature termination of the lease on our part, without restitution of rent.
- Day visits of any guests should always be in consultation with the owner.
- Pets are allowed only in consultation with the owner.
- Due to the general peace and quiet of the area, it should be quiet outside between 22:00 in the evening and 8:00 in the morning. We reserve the right to refuse the group in case of nuisance from then on also for the other booked nights without refund of paid money.
- The entertainment and fitness room are private from the owner and available in consultation. Use of this is not self-evident. Do not use available glasses and drinks here.
- The landlords live at the front of the complex, completely isolated from the rented property. They are always there for questions accessible.
Wellness
- Depending on weather conditions, the pool is heated from April to October.
- The jacuzzi and swimming pool must always be closed after use.
- The winter deck of the jacuzzi must always be opened and closed with 2 people.
Massages
- In this practice, only wellness massages are performed and certainly no erotic massages.
- Before the start of an initial treatment, you may be asked a number of questions regarding your sporting and medical history.
- If in doubt about an existing condition or injury, the performing masseuse may stop the treatment.
- If you are being treated by a doctor, therapist, specialist or similar, we assume that you will be able to have discussed with your doctor whether a massage may be applied.
- All your personal and medical data will never be provided to third parties without your consent.
- The practice is not liable for damage or loss of personal belongings.
- Ethics and hygiene are highly regarded within the practice. We expect guests to take care of this as well carry.
- From a hygiene point of view, it is expected that you have showered just before the massage treatment. This is not only for the masseur more pleasant to work, but also for yourself to undergo the treatment.
- Mobile phones must be switched off during treatment.
- If you withhold information about any skin diseases, injuries or other conditions, you will not be able to responsible for the consequences during or after the massage.
Liability / complaints / damage
- The tenant and other users are fully liable for all damage that has occurred to the house, the inventory and all items belonging to the rented object, unless the tenant and other users can make it plausible that the damage cannot be attributed to them. We therefore recommend that you inspect the holiday home and inventory for defects and deficiencies. If you have damage or defects, please report this to us immediately.
- We accept no liability for theft, loss or damage to property or persons of any kind, during or as a result of the stay in the holiday home. We accept no liability for nuisance caused by construction activities on the access and main roads or surrounding houses etc. in the vicinity of the rented holiday home. We assume no liability in the event of failure or deactivation of technical equipment including the wellness and swimming pool, utilities, the non-functioning or partial non-functioning of the internet.
- The costs of normal maintenance and repair of defects are at our expense. If defects occur, the tenant must inform us immediately and follow our instructions as much as possible. Possibly costs incurred by the tenant in this regard will be paid by us to the tenant on presentation of specified invoices be refunded.
- De Luxerij has a (wireless) internet connection that the tenant can use. It is strictly Illegal down/upload or streaming from the internet! There are high fines for this and it is strictly controlled. The tenant is responsible and liable for his own internet use and if fines are imposed, these will be passed on to the tenant.
- If you still want to submit a complaint, it must be submitted in writing and within 14 days after leaving the holiday home. Motivated to be submitted to us.
Stay in the holiday home
- Cars park in the middle of the parking signs diagonally with the front to the hedge or with more than 4 cars behind the accommodation, via the fence behind the football field.
- The holiday home is non-smoking. Smoking is allowed outside on the terrace.
- HEOS volume boxes outside maximum at 50% and after 22:00 maximum at 25%.
- Climbing trees and buildings is prohibited.
- Food scraps in the waste bins. Do not flush it down the toilet or sink.
- Do not put full garbage bags outside but in the containers that can be found at the back of the football field.
- It is not allowed to enter the house with wet swimwear. The changing room in the tanning room can be used as a changing room. The outdoor toilet should also be used.
- Moving cupboards and beds, as well as sound or television equipment or taking any part of the indoor inventory outside - except of course crockery, glasses and cutlery for your meal outside - is not allowed.
- Always fold parasols after use and in strong winds.
- Do not leave the fireplace in the lounge corner burning unnecessarily.
- Barbecuing with the BBQ is allowed. This must be left clean before departure. If it is not cleaned after use, we can deduct €100 from the deposit.
- It is not allowed to move the BBQ and fire pit.
- Only use extinguishing equipment in the event of a fire. Fire extinguishers are available upstairs at the laundry chute on the first floor, in the massage room and outdoor areas, access to lounge area, sauna, terrace and in the work cupboard next to the front door of the entrance hall.
- The entire building is equipped with smoke and carbon monoxide detectors.
- Garbage in the large container and food scraps in a green container behind the forest of the football field, accessible via the garden gate.
- Do not use fire basket in moderate to strong winds.
- Chair cushions and sunbed cushions can remain in the chairs and sunbeds in case of rain. These are waterproof.
- Barbecuing is only allowed with the barbecue provided.
- Always open skylights in a sloping roofline and never completely upside down and close them in the rain or leave them open in the closing position with a slide. When using air conditioning during the day, always keep everything closed and all interior doors open on the floor.
- Always cover the swimming pool and jacuzzi after use and always turn off the sauna after use. After 22:00 the use of the swimming pool is no longer allowed.
- Always open and close the winter deck of the jacuzzi with 2 people. The summer deck is located in the space to the left of the lounge area.
- It is not allowed to fly a drone above and near the Luxerij.
- Do not use white towels outside. Do not remove towels from massage room.
- Due to the general tranquility of the area, it should be quiet outside between 22:00 in the evening and 08:00 in the morning.
Departure and final cleaning
- The cleaning supplies are located in the corner cupboard next to the front door.
- Remove the bed linen and throw the used bathrobes and towels into the chute next to room 5. Belle Leaving cushion and bed flannels in place.
- Close windows and doors and set the heating to15 degrees. Skylights closed or by means of a slide in the open closing position put. Turn off the air conditioning.
- Leave the house swept clean.
- The dishes must be washed and left in the cupboards.
- Leave dishwasher and refrigerators clean and empty.
- Do not leave any food scraps in the cupboards.
- Emptied the bins, both inside and outside
- Leave the barbecue and oven clean. Also remove ash residues from the barbecue by means of steel stick and in the sink bucket do.
- Take empty bottles with you or put them in the glass containers at the Plus supermarket.
- Report any breakage or damage to the landlord
- Place house keys on the large table in the kitchen.
- Unless otherwise agreed, notify the landlord that you are leaving.
Applicable law
All these terms and conditions and provisions of the rental agreement are governed by Dutch law. .
After booking the Luxury Row, the tenant automatically agrees to these terms and conditions.
